207.06 Military Leave

  1. POLICY

    JSA shall provide time off with pay, as specified below, for eligible employees who are members of the United States Reserve Forces or the National Guard and are called to active duty. JSA also shall provide time off with pay for eligible employees ordered for physical examinations in connection with selective service or military reserve obligations.

  2. ELIGIBILITY
    1. Regular or term (one year or more) full-time and part-time, one-half-time or more employees are eligible for paid Military Leave if they are members of the United States Armed Forces and are ordered to temporary active duty for annual training purposes.
    2. Regular or term (one year or more) employees who work a schedule of one-half-time or more are eligible for paid Military Leave when they are ordered for physical examinations in connection with a selective service or reserve obligation.
    3. Regular or term (one year or more) employees who work a schedule of one-half-time or more, who are members of the United States Reserve Forces and are called to active duty, are eligible for paid Military Leave.
    4. Regular or term (one year or more) employees who work a schedule of one-half-time or more, who are members of the National Guard and are called to active duty to serve during periods of emergency as declared by the Governor of the Commonwealth or State, or are called to active duty by the President of the United States, are eligible for paid Military Leave.
  3. ENTITLEMENTS
    1. An eligible employee shall be granted a maximum of ten (10) work days of paid leave during a calendar year when ordered to temporary active duty for training.
    2. An eligible employee shall be granted paid leave, which may be in addition to the ten (10) days specified in C.1., when ordered for a physical examination in connection with a selective service or reserve obligation.
    3. An eligible employee who is a member of the National Guard and is called to active duty to serve during a period of emergency, as declared by the Governor of the Commonwealth or State, or who is a member of the United States Reserve Forces and is called to active duty by the President of the United States, shall be paid his/her normal salary (straight-time) rate during his/her absence for such duty.
    4. An employee on paid Military Leave shall receive pay in accordance with his/her regular work schedule (i.e., straight-time rate), minus an offset for military pay received.
    5. An employee on paid Military Leave shall continue to receive the same JSA benefits he/she would receive in a work status.
    6. The maximum period for which an employee may receive JSA pay while on Military Leave is six months.
  4. PROCEDURES
    1. An eligible employee ordered to temporary active duty must provide his/her supervisor and Human Resources a copy of the active duty orders immediately upon receipt.
    2. Supervisors should ensure that all paid leave hours are recorded on the employee’s time sheet as Military Leave.
    3. Immediately upon their return to JSA, employees completing Military Leave must furnish the Payroll Office a military pay stub showing earnings during the paid leave period.
