503.02 Work for Others

  1. GENERAL

    There are instances where JLab is approached to accomplish work for funding sponsors other than DOE. It can be for other federal agencies; state, regional or local governments; commercial firms, not for profit organizations, universities or even private individuals. Basically JLab may perform this work when it:

    1. Is consistent with JLab's mission as specified in the prime DOE contract,
    2. Does not adversely affect ongoing programs included in the Institutional Plan,
    3. Does not place JLab in competition with commercial sources which could accomplish the work,
    4. Is based on JLab's specialized scientific capabilities and/or unique facilities, and
    5. Is funded including advance payments if required.

    If JLab is solicited to accomplish work for others, the Office of Technology Applications will provide assistance to the JLab sponsor in obtaining the necessary JLab and DOE approvals and contractual documents.

  2. PROCEDURE
    1. Prior to entering into any commitment to perform work for others, regardless of dollar value, the JLab Principal Investigator or Sponsor must contact the Office of Technology Applications to coordinate the necessary administrative requirements to obtain approval to accomplish the work.
    2. It will be necessary for the Finance Department to establish accounts and ensure that all required financial arrangements are satisfied before the work can be accepted.
    3. Smaller dollar value (less than $100,000), less complex, short performance period type projects may be accepted and accomplished without specific DOE approval, although it is necessary that appropriate JLab management approves of the work and that the five conditions noted above are satisfied. Other projects require approval by the Technology Transfer Manager and the affected Associate Director and will be forwarded to DOE over the Laboratory Director's signature.
    4. The customer will be required to pay full JLab costs to include all direct labor, fringe benefits, other direct costs, overheads and General and Administrative costs. Additional DOE related burdens may be added depending upon the customer's particular business status and current waiver policies.
